Neoethics is the ethics section
of e-Dicta, an internet ezine for the Trial, Torts, and Insurance Section of the
American Bar Association. Bucklin is the
editor and
also contributes ethics articles there from time to time. Bucklin believes there is a new world of
legal and corporate ethics. "Neoethics" is used to emphasize that lawyers
and corporate counsel must look beyond traditional solutions to ethics problems.
Neoethics as a new word exists because the public and government now demand that
the rules governing lawyers respond to the public perception of the moral
choices lawyers and corporate officers should make. These are new requirements
for lawyers and corporate officers - to act in accordance with a public
morality. The results are: a new combined legal/social ethical framework in
which lawyers must work, a new way in which lawyers must perceive ethics as a
subject of study, and new ethics rules and refinements that respond to this
framework and perception. We call this new paradigm --- neoethics
If you are a corporate general counsel, you may want to suggest to your company
management that we be called upon for an ethics audit. You may want assurance
that the ethics culture will pass muster if the government is considering
possible charges. The company and its top management now must have
implement what the government prosecutor and judge call effective measures meeting the standards of the Federal
Sentencing Guidelines. Certainly, using an outside consultant will allow
you to say you are fulfilling the mandate of the Federal Sentencing Guidelines
for simply monitoring the effectiveness of your ethics compliance program. However, in
choosing your outside consultant organization you may want to consider experts
that have the prestige and reputation that allows you suggest, with pride, to
your authorizing authority that they do the corporate ethics audit for your review
as corporate general counsel. If such experts do the audit, you can tell
outsiders that you had an effective active audit, not just a passive monitoring
of your system.

ethics papers, which was original published in the North Dakota Law Review in 2002
. It still remains as the best review of the subject for medical organ
